    Acceptance Insurance is currently seeking a Claims Counsel to join our growing Legal team at our Corporate Office in Nashville, TN (Green Hills area).

     

    Position Summary:

    The position provides legal advice and support for property and casualty personal lines insurance business operations, with primary focus on claims legal advice and support to its Claims functions.  This person will conduct legal research to assist claims professionals on individual claim files; evaluate complex or novel policy coverage issues and complete written memorandum on coverage and legal issues; monitor and report on relevant claims and other property and casualty industry trends and new laws; and provide general legal guidance.

    Company Overview:

    We are principally a retailer, servicer and underwriter of non-standard personal automobile insurance based in Nashville, Tennessee. Our insurance operations actively generate revenues from selling non-standard personal automobile insurance policies and related products in 15 states. We currently conduct our servicing and underwriting operations in 13 states and are licensed as an insurer in 13 additional states.

     

    Acceptance Insurance leased and operated 349 retail locations and a call center staffed with employee-agents. Our employee agents primarily sell non-standard personal automobile insurance products underwritten by us, as well as certain commissionable ancillary products. In most states, our employee-agents also sell a complementary insurance product providing personal property and liability coverage for renters underwritten by us. In addition, retail locations in some markets offer non-standard personal automobile insurance serviced and underwritten by other third-party insurance carriers for which we receive a commission. In addition to our retail locations, we are able to complete the entire sales process over the phone via our call center or through the internet via our consumer-based website or mobile platform. On a limited basis, we also sell our products through selected retail locations operated by independent agents.

    Responsibilities

    • Legal research and drafting written opinions and recommendations with a particular focus on claims litigation and related policy and coverage interpretation.
    • Provide advice and counsel to claims staff regarding coverage, liability and damages in litigated matters
    • Monitor claims and other property and casualty insurance trends and new laws
    • Provide reporting and analysis on new laws, rules, regulations and court decisions and alert key staff regarding necessary changes and associated business impacts
    • Prepare and track responses to subpoenas and other authorized requests for company records and documents, including managing relationship with vendor for outsourced responses
    • Assist with drafting policy forms and contracts
    • Provide litigation management support for matters filed against the company, including extra-contractual liability claims and suits
    • Assist with management and review of legal billing from outside counsel
    • Serve as a liaison between legal department and other internal departments of company
    • Support legal processes and policies
    • Other activities and duties as assigned

    Qualifications

    • J.D. from accredited law school
    • Admitted to practice law in Tennessee or eligible for admission
    • 3-5 years of related experience focused on property and casualty insurance defense litigation in a law firm or in-house legal position
    • Experience handling declaratory judgments, coverage and extra-contractual litigation
    • Attention to detail and ability to effectively organize and prioritize tasks
    • Ability to effectively provide legal analysis and recommendations and to draft other legal documents and correspondence
    • Ability to effectively communicate complex messages to diverse audiences, both verbally and in writing
    • Ability to establish rapport and effective working relationships with business partners, supervisors and peers
    • Demonstrated strong project management skills with ability to manage multiple projects and tight timelines
    • Excellent computer skills including Microsoft Office (Word, Excel and PowerPoint)
    • Notary Public or willing to be licensed
